Terms and Conditions – Studio DrieDay Webshop
These terms apply to all sales of decorative objects (such as vases, sculptures, and related design pieces) via the Studio DrieDay webshop within the European Economic Area.
1. Applicability – The client explicitly waives their own general terms and conditions. Deviations are only valid if agreed upon in writing in advance by Studio DrieDay.
2. Orders & Agreement – An order becomes binding once payment is received. Studio DrieDay reserves the right to refuse any order without providing a reason.
3. Pricing & Payment – All prices are in euros and include VAT, unless stated otherwise. Invoices must be paid within the indicated term. If no term is specified, a payment term of 21 working days applies.
In case of late payment, Studio DrieDay reserves the right to charge a fixed interest of 10%. Services or deliveries may be suspended without prior notice in the event of non-payment.
4. Debt Collection – If payment remains outstanding after 60 days, Studio DrieDay is entitled to engage a debt collection agency. All related (legal) costs will be charged to the client.
5. Taxes & Withholding – Any withholding taxes or local levies are entirely the responsibility of the client. Studio DrieDay must receive the full invoice amount, free of deductions.
6. Delivery – Delivery times are indicative and non-binding. Risk transfers to the client upon delivery. Studio DrieDay is not liable for delays or damages caused by third-party transport services.
7. Complaints & Returns – Complaints must be submitted in writing within 14 calendar days of delivery. Returns are only accepted with prior written approval and must be in original condition and packaging.
8. Liability – Studio DrieDay delivers high-quality products but does not guarantee any specific results. The seller is not liable for indirect damages or third-party claims against the client.
9. Right of Withdrawal (Consumers Only) – Consumers within the EU have the right to withdraw from their purchase within 14 days of receipt, without stating a reason. Refunds are made within 14 days, excluding shipping costs. Products must be returned unused and undamaged.
10. Force Majeure – Studio DrieDay is not liable in cases of force majeure (such as natural disasters, strikes, pandemics, or transport disruptions). In such cases, performance of the agreement may be delayed or terminated without compensation.
11. Governing Law – All agreements are governed exclusively by Belgian law. Disputes fall under the exclusive jurisdiction of the courts of the judicial district where Studio DrieDay is established.
